The United States Congress recently enacted the CAN-SPAM Act ('the Act'). As directed by the Act, the Federal Trade Commission (FTC) has just issued its final Rule to prescribe a "mark" to be included in all commercial electronic mail that contains sexually oriented materials.

EFFECTIVE IMMEDIATELY. All mailings must be pre-approved by your account manager or your account will be terminated immediately and You will not be paid!

ALL AFFILIATES MUST COMPLY WITH THE ACT when promoting the Dating Network

Following are the requirements of the final FTC Rules that you must comply with when sending sexually oriented email to promote our products:

  • The exact phrase 'SEXUALLY-EXPLICIT' must be contained in capital letters as the first 19 characters at the beginning of the subject line. This phrase in the subject line must be in ASCII format.
  • The exact phrase 'SEXUALLY-EXPLICIT' must be in capital letters as the first 19 characters in the 'brown paper wrapper' area of the email message. The Brown Paper Wrapper refers to the opening portion of the e-mail that is immediately visible to the recipient, without scrolling down or taking any other affirmative steps to view the message. Sexually explicit material can be displayed beneath the 'brown paper wrapper' area of the email message or accessible by clicking on a link.
  • A valid postal address must be displayed in the 'brown paper wrapper' area of the email message. In addition, the 'brown paper wrapper' area must indicate that the message itself is an advertisement or solicitation, and contain an e-mail address that the recipient can reply to declining any further commercial e-mail messages from the sender.
  • As CAN SPAM covers both visual images as well as the written word, the subject line must not contain text with written descriptions of Sexually Explicit Conduct. Also the 'brown paper wrapper' area of the email message must not contain Materials with Sexually Explicit Conduct. Sexually Explicit Conduct means actual or simulated sexual intercourse [including genital-genital, oral-genital, anal-genital, or oral-anal, whether heterosexual or homosexual]; bestiality; masturbation; sadistic or masochistic abuse; or lascivious exhibition of the genitals or pubic area of a human being.
  • Violation of the CAN-SPAM ACT may lead to civil and criminal penalties. You should seek proper advice from a qualified legal specialist.
  • All violators will be immediately terminated from the Affiliate Program in accordance with the Affiliate Program terms and conditions and we reserve the right to report violations of the CAN-SPAM ACT.

IF YOU VIOLATE ANY OF THE TERMS AND CONDITIONS BELOW YOUR ACCOUNT WILL BE IMMEDIATELY TERMINATED AND YOU WILL NOT BE PAID!

  1. By signing up with the The Dating Network.com Affiliate Program, you confirm that you have read, understood and agree to abide with all of our terms and conditions.
  2. The Dating Network.com's Affiliate Program will pay you according to the current pay schedule for each premium membership bought from visitors that you send our way. For a copy of the current pay schedule, contact your account representative or sales@thedatingnetwork.com.
  3. The Dating Network.com's Affiliate Program Terms and Conditions may be modified at any time. The date of the last modifications will be stated at the beginning of these Terms and Conditions. You agree that it is your responsibility to be aware of all changes in the The Dating Network.com's Affiliate Program Terms and Conditions.
  4. If you commit fraud or cheat or attempt to cheat our Program in any way, your account will be terminated and you will not be paid.
  5. You are free to generate traffic by any method that is not illegal or in violation of the terms and conditions herein.
  6. The action of sending hits from any URLs which contain and/or promote the following content will result in the immediate cancellation of the account from which the hits were sent and the forfeiture of any funds owed to that account: child pornography, bestiality, rape, password or warez sites, any acts of violence, or any illegal material whatsoever.
  7. The Dating Network.com reserves the right to cancel or change this program at any time, without prior notification. In the case of cancellation of the program, you will be notified and paid ALL accumulated funds up to that point in time, except in cases where it is determined you have committed fraud or cheated by violating this agreement in any way.
  8. The Dating Network.com is not responsible for any loss due to downtimes resulting from complications with hosting equipment or technical errors, or any other technical reason.
  9. Our records alone will prevail in determining amount of premium memberships.
  10. The Dating Network.com reserves the right to terminate your account if it is idle for more than two months.
  11. The Dating Network.com reserves the right to deny any prospective sponsor admittance into our program for any reason whatsoever.
  12. You are solely responsible for the development, operation and maintenance of your website. You are also solely responsible for all materials that appear on your site. You agree that you are not an agent of The Dating Network.com, and we shall have no responsibility for the development, the operation, or the maintenance of your site. We are also not responsible for any materials that appear on your site. You shall also be solely responsible for ensuring that materials posted on your site do not violate or infringe upon any laws, or the rights of any third party (including, for example, copyrights, trademarks, privacy, or other personal or proprietary rights). You are also solely responsible for ensuring that materials posted on your site are not illegal.
  13. The Dating Network.com reserves the right to change the payout rate at any time.
  14. We do not accept accounts from the following countries: Afghanistan, Albania, Armenia, Azerbaijan, Belarus, Bhutan, Bosnia And Herzegovina, Bulgaria, China, Costa Rica, Croatia, Cuba, Estonia, Georgia, Hungary, India, Indonesia, Jordan, Kazakstan, Korea, Kyrgyzstan, Latvia, Lithuania, Malaysia, Republic Of Moldova, Mongolia, Pakistan, Philippines, Poland, Romania, Russian Federation, Singapore, Slovakia, Slovenia, Syria, Taiwan, Tajikistan, Turkmenistan, Ukraine, United Arab Emirates, Uzbekistan, Yugoslavia.
  15. We pay on a weekly basis with our weeks starting every Sunday at midnight. You will only be sent a check if your account balance is at least US $60.00, otherwise your payment will be carried over from week to week until your account has accrued US $60.00. If you choose to receive your payments by wire, the minimum payment is US $1000. Wires are paid weekly and there is a fee of US $35.00.
